Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Lawnly’s lawn care and related outdoor services in Canada. By booking or using any service, you agree to these Terms.
Definitions
- “Lawnly”, “we”, “us”, or “our” means the Lawnly service platform operating in Canada and its authorized service partners.
- “Customer”, “you”, or “your” means the person or entity booking services.
- “Services” means lawn mowing, trimming, edging, leaf cleanup, seasonal yard work, and any add-ons shown at booking.
- “Property” means the service location you specify at booking.
Service Eligibility and Scope
- You must be at least the age of majority in your province or territory of residence to book Services.
- Services are available within supported Canadian service areas shown during booking; availability may vary by postal code and season.
- Standard lawn service includes mowing accessible turf, trimming along edges and obstacles, and blower cleanup of clippings on hard surfaces. Overgrowth, debris removal, pet waste, or hazardous conditions may require add-on fees or refusal of service.
- You authorize Lawnly to capture before/after photos strictly to document service quality, disputes, and training.
Property Access and Safety
- You must ensure safe, unobstructed access to the Property during the scheduled service window (e.g., gates unlocked, pets secured).
- We may decline or pause Services if we encounter hazards (e.g., rocks, toys, branches, glass, steep slopes, poor visibility, aggressive animals).
- Pet waste must be removed prior to arrival. Excessive waste may incur a surcharge or result in cancellation.
- We do not move personal items, furniture, or vehicles. Obstructions may limit serviceable areas without refund.
Bookings and Cancellations
You can cancel up to 24 hours before the scheduled window without a fee.
Scheduling
- Appointments are booked in service windows (typically 2–4 hours). Actual arrival may vary due to traffic, weather, and prior jobs.
- Recurring plans renew automatically per your chosen cadence (weekly, bi-weekly, etc.) until paused or cancelled.
- Weather delays: snow, heavy rain, lightning, or saturated ground may require rescheduling at no fee.
Cancellations and Rescheduling
- Free changes up to 24 hours before your service window.
- Late cancellation (within 24 hours) or failure to provide access may incur a fee of the lesser of 50% of the service price or CAD 45 to cover travel and time.
- If our team cannot access the Property within 15 minutes of arrival due to locks, alarms, or pets, the visit may be marked as “unable to service” and treated as a late cancellation.
- Seasonal pause is available for recurring plans. Resume dates are subject to availability.
Payments
All prices are in CAD and subject to applicable taxes by province.
- You authorize us to place an authorization hold up to the quoted amount before service. The final charge posts after completion based on actual scope.
- We accept major cards and other methods shown during checkout. By saving a card, you authorize recurring charges for scheduled Services and any agreed add-ons or fees.
- If payment fails, you agree to update your method within 3 days. Overdue balances may incur a late fee of CAD 10 and service suspension until resolved.
- Quotes are estimates; significant overgrowth, debris, or add-ons approved by you may adjust pricing. You will see any adjustments on your receipt.
- Tips are optional and go to your service professional where permitted.
Satisfaction Guarantee
- If you’re not satisfied, contact us within 24 hours with photos. We will reasonably attempt a rework or provide an appropriate credit. This guarantee does not cover issues outside the defined Service scope.
Damage and Exclusions
- We use industry-standard practices and equipment. Minor cosmetic wear of grass or edging is normal.
- We are not responsible for damage to hidden or non-visible items (e.g., sprinkler heads, low-voltage wires, landscape lighting, pet fences) not clearly marked or disclosed prior to service.
- Report any suspected damage within 24 hours of service and before any repair work is performed.
Acceptable Use and Prohibited Conduct
- Do not misuse the platform, including attempting to circumvent fees, submitting fraudulent disputes, or harassing personnel.
- Do not request unsafe or illegal work, or work outside the listed Services without prior approval.
- Abusive, discriminatory, or threatening behaviour may result in immediate termination of Services.
Privacy
We collect and use your information to deliver Services, process payments, and improve operations in accordance with applicable Canadian privacy laws. Photo documentation is used for quality, training, and dispute resolution.
Liability
We are fully insured. Indirect damages are excluded to the extent permitted by law.
- To the maximum extent permitted by law, Lawnly will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, goodwill, or business interruption.
- Our aggregate liability for any claim arising out of or relating to the Services is limited to the lesser of: (i) the amount you paid for the specific service giving rise to the claim, or (ii) CAD 500.
- Nothing limits liability for gross negligence, wilful misconduct, or where otherwise prohibited by applicable law.
Covenant of Indemnity
- You agree to indemnify and hold Lawnly harmless from claims arising from your breach of these Terms, misuse of Services, or violation of law, except to the extent caused by our negligence or willful misconduct.
Disputes, Governing Law, and Venue
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
- You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, for all disputes not subject to informal resolution.
- Before any formal action, the parties will attempt to resolve disputes in good faith within 30 days of notice.
Changes to Services and Terms
- We may update these Terms or pricing from time to time. Material changes will apply prospectively and, where required, we will provide advance notice.
- If you continue to use the Services after the effective date of changes, you accept the updated Terms.

Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No Waiver: A failure to enforce a provision is not a waiver of rights.
- Entire Agreement: These Terms constitute the entire agreement regarding the Services and supersede prior understandings.
